James was mentioned in the will of his brother-in-law Robert Issell.(b c. 1817). Robert died leaving 3 young sons (aged about 4 to 10) and a wife, and he left his money to James and to his brother Thomas for the support of his wife and children, until the youngest reach 21 (in c.1870) - the money then to be split between them.
Whilst this might suggest that Robert didn't trusted his wife to cope with the financial situation, it was probably more complicated. If he left the money to her it would become her husbands should she marry again - which being widowed at the age of about 33 she was likely to.
Following Robert's death in 1853 probate was granted twice, once in 1855 and then again, presumably because James' emigration meant it was no longer practical for him to be involved, in 1861. This appears to have been some time after the Steeds emigrated, but it may have been Jane's plans to remarry, which she did late in 1861, that caused Thomas to take the action to put things straight.
